EU 'Returns' (Deportation) Regulation

Published in March 2025, the European Commission's proposal for a “Returns Regulation” sets up a mass deportation machine.

Sold as administrative “tidy-up”, the reality is that it paves the way for: deporting migrants to offshore prisons and to countries they have no prior ties, detaining migrants for longer and more arbitrary reasons, codifying racial profiling and expanding intrusive surveillance of migrants The law caves in to far-right narratives, scapegoating migrants for falling living standards caused by EU and national governments themselves. Migrant and racialised communities – already over-policed – will be spied on, punished and ever more marginalised.

The text proposal expands detentions, deportations, and the EU’s digital surveillance infrastructure, whilst simultaneously legitimising racial profiling by encouraging state-led persecution of migrants (and anyone perceived as such. It includes provisions aimed at expanding the rate of detentions and deportations in the EU, broadening the EU’s increasingly punitive framework on migration, and constructing loopholes for legally disputed ‘return hubs’ - meaning deportation prisons.

In Equinox's paper, EU lawmakers: Reject the Deportation Regulation, we demand a total rejection of the EU’s deportation plans. We call for a redistribution and redirection of resources invested in the EU deportation regime toward infrastructures of care, social protection, not control.
